As Sharon’s on one of her tears about what a mean ol’ meany I am, it’s important to make a few distinctions in regards to the investigation of one David “Orville Redenbacher” Kernell.  This investigation is not about The Last Honest Man ™, Memphis (of all places) rep. Mike Kernell.  This is about his son and what he appears to have done.

The only comparison I’ve made about the sins of the son on the father is the luxurious treatment he’s getting by someone who laid on Palin thick about her underage daughter being pregnant as being a reflection on her.  Last time I checked, pregnancy wasn’t a felony.

Hypocrisy is a stinky perfume but it’s being splashed on like so much Charlie in Cobb Country.

Two, as Sharon has taken it upon herself to be the Kernell Family’s official spokesperson and as they have circled the wagons, called in the lawyers, and dropped all communications with the media - I only have one question.

Did he do it?

Not “can you prove he did it”?  Because judging by his choice of attorneys it looks like he’s going to try and scapegoat somebody else.  Will there be digital DNA evidence in an investigation where circumstantial evidence is damning enough?  They will either have to claim somebody spoofed his account, that one of his roommates did it, or that someone broke into the apartment and did it.

Mind you, when your name is “Kernell” and you change the password on the account to “popcorn” you might just want to go ahead and plea bargain now.  Save yourself a lot of legal fees and family embarrassment.

No indictment has been issued yet but this is far from over:

Justice Department spokeswoman Laura Sweeney declined comment about the grand jury but said afterward in a telephone interview that the “government’s inquiry into this matter is ongoing.”

Three students who arrived at the courthouse accompanied by an attorney early Tuesday went behind closed doors with the grand jury in Chattanooga and afterward were secretly escorted out a back door at the courthouse.

Neither Kernell nor his father has returned repeated phone calls since last week.

So this is my one question to the family’s official spokesperson, “Did he do it?”  The e-mail of the next Vice President of the United States is alleged to have been broken into by your client.  It’s clear to see that The Truth takes a backseat to party every time in Cobb Country.

It’s a simple question that strikes at the heart of people who value privacy.  A too-clever-by-half partisan lied his way into viewing the e-mail of someone who had a reasonable expectation of privacy with the intent of embarrassing or humiliating them with that ill-gotten information.  The computer equivalent of a cat burglar or a Peeping Tom with a political axe to grind.  He just happened to do it to someone under Secret Service protection.

Luckily for Palin, none of her credit card numbers, social security number, or any other personal information has been thrown to the wolves because that was the intent.  To find some salacious material in order to defame and humiliate.  That was the admitted intent:

I read though the emails… ALL OF THEM… before I posted, and what I concluded was anticlimactic, there was nothing there, nothing incriminating, nothing that would derail her campaign as I had hoped, all I saw was personal stuff, some clerical stuff from when she was governor…. And pictures of her family

I then started a topic on /b/, peeps asked for pics or gtfo and I obliged, then it started to get big

Earlier it was just some prank to me, I really wanted to get something incriminating which I was sure there would be, just like all of you anon out there that you think there was some missed opportunity of glory, well there WAS NOTHING, I read everything, every little blackberry confirmation… all the pictures, and there was nothing, and it finally set in, THIS internet was serious business, yes I was behind a proxy, only one, if this shit ever got to the FBI I was fucked, I panicked, i still wanted the stuff out there but I didn’t know how to rapidshit all that stuff, so I posted the pass on /b/, and then promptly deleted everything, and unplugged my internet and just sat there in a comatose state

In a nutshell, that says “I did this to harm Sarah Palin but I did not have the technical ability to circulate all of her personal information so I gave it to other people to do it.  I knew what I did was probably illegal so I tried to cover my tracks.”

Again, the moral equivocators would like to compare dubious allegations of wrongdoing by Palin using a Yahoo account to the government eavesdropping on terrorists but that is wrong on multiple levels.   Try using that defense in the courtroom and see where it gets you.

To the people spinning the connections to the Obama campaign or the Under Orders From His Father conspiracies, I would advise not to overplay your hand here.  You’ve been given a gift in that the anti-PATRIOT Act liberals have been shown that they are completely in favor of unlawfully intercepting communications as long as you have an (R) next to your name.  Wiretapping terrorists?  Hrm, not so much.

Kernell overplayed his hand, don’t overplay yours.

“Doing the right thing” and “what is best for their son” don’t have to be exclusive terms.  All you have to do is tell the truth and you never have to worry unless, of course, you’re guilty.

1. Here’s the facts.

   The owner of ctunnel.com looked at his logs and logged the IP using his proxies directly to David Kernell, directly to his apartment.

   Kernell’s attornies can argue until they are blue in the fact about “spoofing” and any number of unlikely possibilities, but when the smoke clears and the bullshit drops the sole fact remains: Kernell used his computer in his apartment to filter through ctunnel.com to hack into Palin’s email.

   That’s not libel. That’s the facts as reported by tech media.

   As a blogger you can be cautious about fingering Kernell for a serious federal crime on pain of libel, but you can’t deny the facts when the owner of the proxy service submits his very logs to the FBI which show the IP used was the very one filtered through the proxy server used in the actual break-in.

   Data can’t be spoofed no matter how much a mouthpiece argues that it can be.

2. You know the name of the game - throw some techno-mumbo-jumbo in front of jury full of people who couldn’t get out of jury duty and hope something sticks.

   Remember, Tennessee let Mary Winkler go after she unplugged the phone and shot her preacher husband in the back while he was sleeping. She showed a jury her pair of high-heeled stripper shoes as a sign of the abuse she suffered.

   Something tells me some people will start tuning out when you start examining IP ranges. Start waving around some CAT-5 and yelling “If he didn’t jack it, he couldn’t hack it.”

3. What will be even more interesting is to see just how long they can drag this whole affair out. The Lamestream Media already show little interest in reporting this case. If Kernell and his attorney listen carefully to the advice of Obama/Axelrod/DNC counsel, it will disappear like a fart in the wind until at least November 4th and by then no one will give a shiite…..
